Deal Pending Regarding
Niles Nativity Scene Dispute

      In a telephone negotiation session yesterday afternoon, Niles, Illinois officials and Rob Sherman Advocacy agreed to a deal to resolve the municipal nativity scene dispute without going to court.  Niles officials agreed to put the terms of the deal that we agreed to in writing and sign off on them within the next few days.  Once the deal is signed, the terms of the deal will be revealed here.

      The proposed deal is the kind that Rob Sherman Advocacy specializes in:  Both sides win and neither side is made to look bad.  Niles will not say, nor be asked to say, that they have done anything wrong.  This settlement isn't about proving whether I was right or they were wrong.  Rather, the settlement is about finding a way to do things better.

      Instead of going to court, Niles will take voluntary action that will bring them within the standards permitted by the constitution as defined by the case law that was referred to in editions of Liberal News & Commentary from earlier this week.  By taking voluntary action, the issue of whether or not their current display is constitutional becomes moot.  By making the constitutionality of the current display moot, neither side is made to look bad.  By ensuring that neither side looks bad, both sides come out looking good.
